This is how we work.

UK Mainland Customers:

• First order: Pro-forma cheque or transfer
• Minimum order value £200. (carriage paid)
• Subsequent orders: 30 day credit terms subject to references

Non UK Mainland Customers:

• Minimum order value £200. (We supply on an ex-works basis, please contact us for a carriage quote.)
• First & subsequent orders: Pro-forma cheque or transfer

Returns:

Only incorrect deliveries and damages reported in writing within seven days will be taken into account.

We use Business Post's 24 hour service and can provide PODs on request.

LUCKIES OF LONDON LTD TERMS OF TRADING

all orders are accepted subject to these terms and conditions of sale

terms Initial Orders will be accepted strictly on a proforma basis. Applications for credit accounts will considered only if accompanied by acceptable trade references.

credit account terms Unless otherwise stated all invoices due for payment within 28 days from date of dispatch. Orders for non-standard goods will be accepted only with a minimum of 50% deposit and full payment upon delivery. If payment is not made by the due date credit terms may be withdrawn. Interest on overdue invoices shall accrue from the date when payment is due until the date of payment at a rate of 2% per month above Abbey Bank.s base rate per month from time to time in force and shall accrue after as well as before any judgment. Any variation in the order agreed between the parties shall entitle LUCKIES OF LONDON LTD to vary the price to cover the cost of such variation.

warranties and liabilities Subject to conditions and provided the total price has been paid by the due date for payment, LUCKIES OF LONDON LTD warrants that the Goods will correspond with their specification at the time of delivery and will be free from defects in material and workmanship. LUCKIES OF LONDON LTD will (at its own choice) either replace, repair, or give credit for Goods found to be faulty within LUCKIES OF LONDON LTD.s warranty period relevant to Goods of that type. Unless otherwise stated the standard warranty period for all goods supplied by LUCKIES OF LONDON LTD will be 12 months from the date of purchase.

LUCKIES OF LONDON LTD will as far as possible endeavour to ensure that all goods supplied are safe and compliant with any relevant standards with regard to the specific intended and stated use for the goods. LUCKIES OF LONDON LTD cannot be held responsible for defects arising from misuse or mishandling of goods. Any fault or damage to the goods supplied should be reported to LUCKIES OF LONDON LTD immediately, failure to do so may affect the warranty.

The Customer will indemnify and keep indemnified LUCKIES OF LONDON LTD against all claims, proceedings, costs and expenses in connection with any third party claim based upon any allegation that the safety of the Goods (or materials or components comprised within the Goods or any goods in which the Goods are incorporated) is not such as persons are generally entitled to expect, save where such deficiency in their safety was present at the time the Goods were despatched to the Customer or its agents by LUCKIES OF LONDON LTD or its agents.

retention of title All products supplied to the Customer by the LUCKIES OF LONDON LTD, shall remain the sole and absolute property of the LUCKIES OF LONDON LTD, both in law and equity until the Customer shall have paid to LUCKIES OF LONDON the agreed price, together with the full price of any other products supplied by LUCKIES OF LONDON LTD, pursuant to any other contract between them.

The Customer.s right to possession of the products shall cease if it does anything or fails to do anything which would entitle a receiver to take possession of any assets or which would entitle any person to present a petition for winding up (or in case of a person or firm commit an act of bankruptcy).

Notwithstanding the retention of property by LUCKIES OF LONDON LTD in accordance with the above provisions, all products supplied by LUCKIES OF LONDON LTD shall be at risk of the Customer as soon as they are delivered to the Customer.s premises or otherwise to order. The Customer shall hold any proceeds of sale as a fiduciary until its account with LUCKIES OF LONDON LTD is settled.

damages or non-delivery Any damages or non-delivery must be reported immediately . no complaints can be considered unless made within 7 working days of receipt of goods.

carriage and goods in transit Unless stated, quotations do not include cost of transportation. LUCKIES OF LONDON LTD are able to arrange carriage of goods to any UK or international address and will always seek to use the most cost effective service insofar as this does not affect quality of service.

LUCKIES OF LONDON LTD are responsible for ensuring that goods are adequately packaged for safe transportation of goods supplied. The Customer is responsible for ensuring the safe onward transportation where LUCKIES OF LONDON LTD are delivering to any central distribution centre, holding warehouse or other such building, where the items will be split and transported onwards.

LUCKIES OF LONDON LTD does not guarantee that any individual item.s packaging will be sufficient for onward transportation unless a specific agreement has been made when the contract is agreed. LUCKIES OF LONDON LTD reserve the right to make additional charges where such a requirement becomes apparent at a later stage.

LUCKIES OF LONDON LTD does not accept any responsibility for any packages lost in transit or for any damage occurred in transit where the goods have been sufficiently packaged (eg. Goods left outside in rain)

damaged goods Any claim for damaged or defective goods can only be entertained if the goods are returned to LUCKIES OF LONDON LTD in their original packaging or similar suitable packaging to ensure sufficient protection in transit or if the goods are made available for collection from the location to which they were originally delivered by LUCKIES OF LONDON LTD or its authorised agents.

with specific regard to bespoke work carried out and goods supplied under contract The contract may in part take the form of Purchase Orders accepted and acknowledged by LUCKIES OF LONDON LTD and any written agreement entered into with relation to such orders. No works shall commence until such orders have been issued by the Customer and accepted and acknowledged by LUCKIES OF LONDON LTD. Furthermore no works shall commence until satisfactory payment on account of the contract has been received by LUCKIES OF LONDON LTD in accordance with our standard terms and with the specific terms of the contract.

warranties and liabilities for bespoke work carried out and goods supplied under contract Goods supplied or works carried out by LUCKIES OF LONDON LTD will unless otherwise stated be guaranteed against malfunction or failure as a result of substandard materials, workmanship or design to the extent as this is covered by the contract and for a time period specified in the contract or for the anticipated duration of the project if this is less than 12 months. LUCKIES OF LONDON LTD limits its responsibility to claims for damages to the extent of and in accordance with the contract. Any claims arising from misuse or mishandling of any goods supplied will not be entertained.

Any goods supplied will be covered by the LUCKIES OF LONDON LTD standard warranty and this may be extended or shortened in accordance with the terms and requirements of the contract. LUCKIES OF LONDON LTD will within a reasonable time period with respect to the contract and at its own choice either replace, repair, or give credit for Goods found to be faulty in material, design or workmanship within the warranty period for such goods.

change to terms These terms are variable and subject to change without notice and LUCKIES OF LONDON LTD reserve the right to vary these terms from time to time as we see fit. Furthermore these terms may be withdrawn without notice and may vary from contract to contract. A written copy of our current terms is available upon request.
